DALES HISTORIC VEHICLE CLUB

CLUB RULES

1. TITLE.

The name of the Club will be Dales Historic Vehicle Club, hereinafter called the Club.

2. OBJECTIVES.

a) To further the interest in motoring and motor sport, with particular reference to motor vehicles
exempt from Excise Duty (V.E.D.) Vehicles over 25 years old.

b) To provide members with information, advice and assistance on matters connected with
Motoring and motor sport with particular reference to motor vehicles specified at 2a.

c) To watch the administration of laws and regulations within the United Kingdom and the
European Community in general, affecting motoring and motor vehicles with particular
reference to such vehicles as above and to report any local action or scheme to the R.A.C.
Motor Sports Association Ltd. or any other body as the committee may deem appropriate.

d) To promote activities in accordance with the rules of the R.A.C. Motor Sports Association
Ltd. with particular reference to motor vehicles mentioned as above.

e) To arrange tours, lectures, discussions, social and other meetings.

f) To afford members such benefits and privileges as it may be possible to arrange.

 

3 CONSTITUTION.

a) Membership will be open to ladies and gentlemen of not less than 17 years of age.
All applications must be made by an individual in his own correct name and be signed
by the said applicant personally. Applications by persons under the age of 18 years must
be countersigned by a parent or guardian.

A membership waiting list will be maintained. A MAXIMUM OF ONE HUNDRED
MEMBERS WILL BE PERMITTED.

b) Membership will consist of the following classes and joining fees for the time being will
be as follows:-

ORDINARY £10 JOINT £15

LIFE TEN TIMES THE ANNUAL FEE OF THE MEMBERSHIP APPLIED FOR.

RENEWAL WILL BE AT THE FEES TO BE DETERMINED AT THE ANNUAL
GENERAL MEETING.

c) A honorary member will be a Club member who, in the opinion of the duly elected committee
has made an outstanding contribution to the furtherance of the aims of the Club. The
committee may, at their discretion award honorary membership of the Club to a non-member whom they consider has made considerable assistance towards the objectives of
the Club.

d) Life members will be Club members who have paid a sum equal to ten times the joining fee.

4 MANAGEMENT.

The responsibility and authority for the transaction of the business of the Club and for its
management will be invested in the committee, who in addition to the powers and authorities
these rules expressly confer on them, may exercise all powers and do acts in furtherance of the
objectives for which the Club is established other than those hereby expressly directed or required
or done at the Club Annual General Meeting.

5 COMMITTEE.

The committee will consist of, a minimum of 3 members up to a maximum of 7, exclusive of the Treasurer and Secretary. The Committee will elect from amongst its own members a Chairman and Vice Chairman.
One half of the members of the Committee will form a quorum. Nominations of candidates
for election must be received by the Secretary not later than the Club meeting immediately
Prior to the Annual General Meeting, with intimation in writing that he or she is willing to serve
Nomination of candidates will be signed by the member proposing them. The committee will have
Power to appoint a sub-committee of not less than three persons to meet on its behalf in respect of any matter which is specifically referred to such a sub-committee.

A committee member will normally be expected to serve a term of office not exceeding three years. However at the discretion of the members of the Annual General Meeting that committee
Member may be re-elected for a further term of office.

It is expected that any committee member taking on the role of deputy to any committee post will
Take on the main post in the case of retirement of the holder. The committee will elect from amongst its members the chairman and vice chairman.

6 ELECTION OF OFFICERS.

The Treasurer, Secretary of the Club will be elected at the Annual General Meeting and, subject to termination of office by resignation at the Annual General Meeting three years following their appointment. The Committee will have the power to co-opt other members as they deem necessary. The retiring officers and other members of the Committee will be eligible for re-election after their term of office has expired.

7 MEETINGS OF THE COMMITTEE

The Secretary, either of his/her own accord or by the direction of the chairman will unless otherwise agreed by the committee give at least seven days notice, in writing, of any meeting of the committee.

8 ABSENCE FROM COMMITTEE

Any member of the Committee who will, without sufficient reasons, absent himself from three consecutive Committee meetings may be called upon to resign his position upon the Committee.

9 DUTIES OF THE SECRETARY

It will be the duty of the secretary and/or deputy secretary to attend all meetings of the Committee and take minutes of the meeting. Such minutes can be kept on computer and a hard copy pasted in a book and presented for confirmation at the following meeting. All correspondence relating directly to the Club will be addressed to the secretary. However, any entries for a specific event and fees for that event may be sent direct to the organiser of that event, who will account to the Treasurer for all monies received and expended on behalf of the Club.

10 BANKING

All monies of the Club will be banked by the treasurer in the name of the Club, and no disbursements will be made from them except in accordance with the form or forms authorised by the committee.

11 MEMBERSHIP OF OTHER CLUBS.

Membership of any other Club or organisation will not entitle an applicant to membership of this Club, either free or at a reduced rate.

12 SUBSCRIPTIONS

Membership of the Club will be by payment of the appropriate subscription and that membership will commence on the 1st April of any one year and end on the 31st March of the following year.

13 NON PAYMENT OF SUBSCRIPTIONS

Any member of the Club who has not paid the membership subscription by the AGM may, unless sufficient reason be shown to the committee be taken off the Club register forthwith. No member whose subscription is in arrears may take part in any activity organised or promoted by the Club. Any member, whose membership subscription has lapsed, as above, will be required to pay full joining fee and yearly subscription fees, as appropriate, at the total discretion of the committee.

14 EXPULSION OF MEMBERS

It will be the duty of the committee if at any time they are of the opinion that the interests of the Club so require, by letter to invite ant member to withdraw from the Club within the time specified in such letter, and in default of withdrawal to submit the question of their expulsion to a meeting of the committee to be held within four weeks of the date of such letter. Members of the committee will be given at least seven days notice that a question of withdrawal or expulsion is to be discussed at such a meeting of the committee.

The member whose expulsion is under consideration will be given at least seven days notice of such a meeting, and will be allowed to offer an explanation of their conduct either verbally or in writing, and if a majority of the members of the committee present vote for their expulsion they will cease to be a member of the Club.

15 THE ANNUAL GENERAL MEETING

The Annual General Meeting of the Club will be held in the month of April in each year upon a date and at a time to be fixed by the Committee. The Annual General Meeting will: -

a) Receive from the Committee a full statement of accounts duly audited showing the receipts and expenditure for the year ending 31st December the previous year.

b) Receive from the Committee a report of the activities of the club during said year.

c) Elect the Secretary and the Treasurer of the club, and if appropriate the Solicitor and Auditor.

d) Elect the Committee.

e) Settle any remuneration for the officers of the club and Solicitor and Auditor.

f) Decide on any resolution which may be duly submitted to the meeting as hereinafter provided.

16 SPECIAL GENERAL MEETING

A Special General Meeting may be convened by direction of the Committee, or on a requisition of the Secretariat stating the business for which the Special General Meeting is required and signed by not less than six members may convene such a meeting. Twelve members will form a quorum.

17 AGENDA

When members wish a matter to be discussed Ata general Meeting, the text of such matters signed by at least two members will be sent to the Secretary at least fourteen days before the date of such meeting, so that it may be included in the Agenda of the meeting.

A copy of the Agenda will be sent to each member at least five days prior to the meeting, but the fact that any member has not received a copy of the Agenda will not invalidate the proceedings. No business that is not included in the Agenda will be discussed at the meeting unless every member present is in favour thereof. Should the proposer of any motion fail to move a resolution in respect of the relevant item on the Agenda, then any other member will be entitled to do so.

18 VOTING

Every member with a right to be present may exercise one vote. The chairman will not vote except in the exercise of a casting vote. At all General Meetings, except as provided in Rule 22, a majority of votes decides a resolution.

At any General Meeting any ten members may demand a Poll, and thereupon the meeting will be ajourned to a time and place to be named by the Chairman, and a postal vote will be taken of all members of the club, the decision of the members, as shown by a postal vote, will be reported to the adjourned meeting, and will be deemed to be the decision of such meeting.

19 RIGHT TO BE PRESENT

No one can take part in the General Meetings unless he/she have duly been elected as a member of the Club, and has paid his/her subscription according to the rules.

20 OBSERVATION AND INTERPRETATION OF THESE RULES

All members bind themselves to abide by the rules, and any modification thereof made in conformity with such rules, and also accepts as final and binding the decision of the committee on all cases of dispute or disagreement as to the interpretation of these rules.

21 EVENTS

All motoring activities promoted by the club will be under the rules of the R.A.C. Motor Sports Association Ltd.

22 ALTERATION OF RULES

Any alterations may be made in these rules by a General Meeting provided, a) that details of the proposed alteration or alterations are included in the notice of the General Meeting and b) that the resolution proposing such alteration is carried by a simple majority of those present and voting at such General Meeting or by a simple majority of those voting should a Poll be demanded, as provided for in Rule 19.

23 VOTING OF COMMITTEE MEMBERS

Each member present at a meeting of the Committee will be entitled to exercise one vote. The Committee will vote by ballot if any member present so demands. A vote of a simple majority against any application for membership will exclude from membership.

24 USE OF CLUB NAME AND ADDRESS

The name and address of the club will not be given by a member as his address for trade, advertising or business purposes or in connection with any legal proceedings.

25 DISSOLUTION

The Club may be dissolved by a Special General Meeting convened by direction of the committee, or on the requisition of the majority of the members. If the resolution is duly passed the committee will forthwith liquidate the affairs of the club, and if there are any surplus assets on realisation these will be disposed of at the discretion of the committee before the club is finally wound up.
